THIS Saturday may be your only chance to ask a Blair Mountain discussion panel of historians how the West Virginia State Historic Preservation Officer can get by with committing constructive fraud on behalf of coal company lawyers!
This Saturday Paul Nyden will host a panel discussion on “The Battle of Blair Mountain: A Historical Perspective” at 1 p.m. and a reception at 2 p.m.
Gazette reporter Paul Nyden will lead the discussion with panelists John P. David, Stan Bumgardner and Fred Barkey. This will be your chance to ask Dr. Nyden why the Gazette hasn’t pressured either ex-governor Manchin or acting governor Tomblin why their WV State Historic Preservation Officer (“SHPO”) hasn’t yet been fired.
According to the SHPO’s website, The very mission of the West Virginia Division of Culture and History is to “identify, preserve, protect, promote and present the ideas, arts and artifacts of West Virginia’s heritage, building pride in our past accomplishments and confidence in our future”. Yet the SHPO has done everything it possible could to destroy it.
DEMAND THEY FIRE OUR WV STATE HISTORIC PRESERVATION OFFICER OVER THE BLAIR MOUNTAIN DEBACLE
Join us prior to the event for a silent protest to let folks know that the WV State Historic Preservation Officer (“our SHPO”) is actively keeping Blair Mountain from being deep mined so that the historic battlefield may be preserved and developed.
Blair Mountain is the only historic resource to have ever been taken off the official list of historic places. And it was done so because of constructive fraud by our SHPO. Lawyers for surface mine operators submitted a list of property owners who they claimed had objected to having Blair protected. The only problem is, that list contained names of numerous individuals who had no legal standing to object! In fact their list included dead “objectors“, one of which had passed away 27 years earlier. And our WV STATE HISTORIC PRESERVATION OFFICER KNEW IT!
Prior to submitting any list of Blair’s landowners for consideration by the National Parks Service, our SHPO had the legal responsibility to certify that both the opponents and proponents are qualified under the law. But when our SHPO’s certification failed the test of legality, he directly refused to remove them as the Federal Authorities had instructed him!
While it is under consideration, it was also our SHPO’s responsibility to inform all land owners of the advantages to having their land listed as a historic place. Our SHPO has never done that, either, despite several studies by both the state and the feds showing that deep mining the coal in that mountain while developing the historic resource.

This just in… Archeologist Brandon Nida was added to the panel after he personally called and asked Nyden why none of those archeologists and historians who had been working so hard to preserve Blair Mountain were never asked to be on the panel. Dr. Nyden invited archeologist Nida to sit on that panel AFTER he instructed Mr. Nida not to mention the nominating process or the ongoing court battle.
